The Government operate a scheme which is administered by the Legal Services Commission to enable people of limited means in England and Wales receive high quality legal advice, assistance and representation.
 

 Only those firms who have been approved by the Legal Services Commission are able to provide legal advice and representation within this scheme.
 

Legal aid helps with the costs of legal advice for people who cannot afford it.
 

 At Avery Naylor we are able to provide a full range of family legal services to those who qualify for legal aid and this includes advice, assistance and representation on all aspects of relationship breakdown, including financial and children disputes.
 

 Whether or not you get legal aid will depend not only on the nature of the problem, but also the income you get and your savings.  You need to be aware that even if you do qualify legal aid is not always free.  It is possible that you may still have to pay either by way of a lump sum payment, regular monthly instalments or repaying your costs from money or other assets that you have kept or received by way of a successful outcome.  The latter is known as the Statutory Charge.  In certain circumstances you may have to pay costs to the other side even though you have had the benefit of legal aid.
 

 We are paid direct by the Legal Services Commission for any work we do on your behalf under the terms of their public funding scheme.  You have a duty to keep both us and the Commission informed of any and all changes to your financial circumstances throughout the period in which you receive legal aid, as a review and re-assessment of your means may be necessary.
 

 The rules surrounding legal aid can be complicated but we are happy to provide a free assessment of your eligibility and discuss the scheme in greater detail.  However you do need to tell us at the outset if you have received legal aid in the past.
 

 To enable us to carry out an eligibility test it will be necessary for us to see full details of your own (and your partner’s if applicable), income, savings and outgoings.  We will require your most recent wages slips and bank statements and it may be necessary for us to request other specific information and evidence from you to verify your eligibility.
 

 If you are in receipt of any state benefits again we will need documentary evidence of this from you.
